The term “graphite” as used in this access condition refers to: crystalline graphite (also known as flake graphite), microcrystalline graphite (also known as cryptocrystalline graphite, earthy graphite), and high purity graphite, expandable graphite, and flexible graphite. Construction conditions and production layout (1) Newly built and rebuilt and expanded graphite projects must comply with national industrial policies, local industrial development plans, and overall land use planning, and coordinate the rational allocation of resources, energy, environment, safety and market. (2) It is strictly forbidden to build and expand graphite projects in scenic spots, ecological protection areas, natural and cultural heritage protection areas, drinking water source protection areas, urban built-up areas and urban non-industrial planning areas.

(6) If the existing graphite project's recovery rate, recovery rate or finished product rate does not meet the above requirements, it shall be reached before the end of 2014 through technical transformation. Energy, water resource consumption and comprehensive utilization (10) Newly built and rebuilt and expanded graphite projects, the comprehensive energy consumption per ton of products should meet the following criteria: 1. If the existing energy consumption of the existing graphite project is higher than the above standards, it should be achieved through technical transformation before the end of 2014 (except for the use of clean energy). (11) Newly built and rebuilt and expanded graphite projects, energy conservation assessment and review should be carried out. Enterprises that consume more than 5,000 tons of standard coal annually should submit an annual report on energy use, including energy consumption, energy use efficiency, energy conservation goals, energy efficiency analysis, and energy conservation measures. (12) Newly built and rebuilt and expanded graphite projects, water resources should be recycled. The water recycling rate of the flake graphite and microcrystalline graphite process is not less than 95%. The water recycling rate of high-purity graphite and expandable graphite process is not less than 80%, and the recycling rate of circulating water in the plant is not less than 60%. In the existing graphite project, if the process water cycle utilization rate does not meet the above requirements, it should be achieved by the end of 2014 through technical transformation. (13) Encourage the comprehensive utilization of tailings resources and vigorously develop circular economy. V. Environmental Protection (14) The graphite project strictly implements the environmental impact assessment system and the “three simultaneous” system, strictly controls the total amount of pollutants, and prohibits excessive discharge. (15) Key tobacco and dust generation processes such as raw material transportation, crushing and treatment shall be equipped with dust suppression and dust removal facilities. After being treated, the flue gas meets the requirements of GB 9078 “Industrial Kiln Air Pollutant Discharge Standard”, GB 16297 “Integrated Emission Standard for Air Pollutants” or the environmental standard of the project site. (16) For the production of high-purity graphite by chemical method, the use of hydrofluoric acid method is prohibited, and the corresponding wastewater treatment facilities shall be constructed. Wastewater discharge meets GB 8978 Integrated Wastewater Discharge Standard. (17) Using low-noise equipment and setting noise barriers for noise control, the noise complies with GB12348 “Environmental Noise Emission Standards for Industrial Enterprises Boundary”. (18) Existing graphite production enterprises shall conduct a round of mandatory clean production audits every five years and pass assessment and acceptance, establish an environmental management system, and formulate a comprehensive emergency plan for emergency environmental incidents. (19) Existing graphite enterprises should formulate tailings pollution prevention and control plans, and tailings should be discharged into tailings facilities that meet environmental protection requirements to reduce the environmental pollution and damage of tailings. VI. Safety Production, Occupational Health and Social Responsibility (20) Newly built and rebuilt and expanded graphite projects shall comply with the laws and regulations such as the Safety Production Law, the Mine Safety Law and the Occupational Disease Prevention and Control Law, and have considerable safety production and Conditions for the prevention and control of occupational disease hazards, and establish and improve the responsibility system for production safety. (21) Safety production and occupational disease protection facilities for new and renovated and expanded graphite projects shall be designed, constructed and put into use at the same time as the main project, and shall be examined and accepted by the safety production supervision and administration department according to law, and obtain a safety production license according to law. After engaging in production activities. (22) The new graphite project tailings pond should be dammed once and equipped with online monitoring devices. Reconstruction and expansion of graphite projects should be rectified according to the provisions of the original tailings pond, the existing graphite project tailings pond should be rectified before the end of 2014. (23) Pay taxes according to the regulations, not pay the employees' wages, and pay the pension insurance, medical insurance, work injury insurance, unemployment insurance, maternity insurance premium and housing accumulation fund in full according to the regulations. (24) Establish an occupational health and safety management system. VII. Supervision and Management (25) Newly built and rebuilt and expanded graphite projects must meet the conditions for access. The investment management, land supply, environmental assessment, occupational hazard assessment, energy conservation assessment, safety license, credit financing, etc. of the graphite project shall be based on the access conditions. If the conditions for non-compliance are not met, the relevant departments shall not go through the relevant procedures for project construction. No credit support. (26) The project shall be approved for construction, land, environmental protection, safety, credit, etc., or may be approved for construction. The project construction shall be designed and constructed by qualified units. Before the project is put into production, it must be supervised and inspected by the industrial department in conjunction with the land, environmental protection, safety supervision and other relevant departments in accordance with the access conditions and relevant regulations. If the inspection does not meet the conditions for access, it shall be ordered to be rectified and shall not be put into trial production. (27) Existing graphite projects shall meet the standards stipulated in these access conditions through technological transformation and strengthening management. (28) The competent industrial and information authorities at all levels shall strengthen the supervision and inspection of the implementation of the conditions for the entry of the graphite production enterprises. Relevant industry associations and intermediaries should actively promote and implement the national industrial policy, strengthen industry self-discipline, and assist in the supervision of the industry. (29) The Ministry of Industry and Information Technology announces the list of graphite production enterprises that meet the requirements for access, accepts social supervision and implements dynamic management. The management of the announcement shall be separately formulated by the Ministry of Industry and Information Technology. VIII. Supplementary Provisions (30) The access conditions apply to all graphite production enterprises within the territory of the People's Republic of China (excluding Taiwan, Hong Kong and Macao). (31) The laws, regulations, standards and related policies and related policies involved in the access conditions shall be implemented in accordance with the latest version. (32) The access conditions shall be implemented from the date of promulgation, and the Ministry of Industry and Information Technology shall be responsible for the interpretation and organization of the amendments.
